The Weinstein Trial Firm is proud to counsel and represent the interests of sophisticated clients across Florida and beyond. We are business litigators who leverage extensive trial experience, a mastery of procedure and evidence, and use of the latest technologies to provide unparalleled advocacy and results for small and medium-sized businesses as well as international enterprises. We are unphased by those who brag of head counts, office size and the highest hourly rates because we know, and in every case we show, those things do not themselves make a law firm better.
BEING better, is better.
Every case presents a unique problem in need of an effective solution. With hundreds of litigated cases and dozens of jury trials behind us, we take incomparably effective courtroom experience and deliver well-planned, advantageous solutions in every case, every time.
Our method isn't magic, we just do the work others do not. We dig, we find, we analyze and we learn each fact and each avenue of legal support for every claim and defense in a matter, and then deliver to our clients a unique, targeted plan to efficiently but effectively achieve their objectives.
The Weinstein Trial Firm serves as Florida litigation counsel to a number of clients with national and international presence. We are also engaged by regional and national law firms as well as numerous in-state general practice firms and attorneys to represent the interests of their clients as their Florida litigation counsel. We provide the latest legal intelligence, insights and experience in most local venues and guide all of our clients through the complexities of litigating in any of Florida's courts.
The Weinstein Trial Firm purposely represents clients in a variety of industries facing a variety of complex issues. Broad practice representation is not just good for business, but our experience litigating and sometimes trying cases across a wide range of industries gives us a uniquely broader perspective in every individual dispute. It allows us to evaluate matters with more insight and identify or in many cases create advantageous solutions where others cannot.
Here you will find some of the areas the Weinstein Trial Firm currently litigates in courtrooms around Florida:
When business relations sour and agreements are broken, legal recourse is often unavoidable. Careful analysis and understanding of the agreements in place, identifying all available remedies, especially not so obvious ones, and thoroughly vetting the law that applies to both actual and potential issues are where we differentiate ourselves. Weinstein Trial Firm attorneys have litigated or tried commercial disputes of nearly every kind and complexity including employment agreements, license and royalty agreements, real estate transactions, non-compete agreements, professional services agreements, construction contracts, service contracts, warranty claims, commercial foreclosures, class actions, insurance and coverage disputes, fraud and unfair competition claims, and numerous other commercial claims and suits.
A cornerstone of our practice, the Weinstein Trial Firm has for many years represented product, equipment and vehicle manufacturers, distributors, suppliers, retailers, and sometimes their insurers, in claims of personal injury and wrongful death associated with the use or exposure to a variety of products, vehicles, machinery and substances. We have a particular specialty representing manufacturers, installers and maintenance providers in the vertical transportation space. Over the past 25 years attorneys of the Firm have defended—many times to jury verdict—hundreds of claims alleging product harm due to negligent maintenance or repairs, flaws in product design or warnings, or misrepresentations in product marketing. We have a deep understanding of the complexities involved with products liability claims that starts with accident scene and product preservation, and includes document productions and witness testimony, vetting and securing the most knowledgeable experts in the field in support of our defenses, and dismantling our opponent’s experts’ theories with effective cross-examinations supported by our extensive library of authoritative literature and litigation materials. We work hard to debunk unmerited claims with appropriate motions, and we have a track-record of success striking or limiting expert testimony and securing summary judgments in difficult cases. However, we are always prepared to go to trial on any remaining issues and defend our clients’ products and services no matter what theories may be presented to a jury.
The Weinstein Trial Firm has represented some of the largest companies in the world in defense of injury and wrongful death claims alleged to result from exposure to asbestos and asbestos-contaminated talc. In addition to our role as litigation and trial counsel, we are often engaged in pre-suit stages to implement and direct investigations, manage subpoena responses and records production, and prepare 30(b)(6) witnesses for testimony at deposition or trial. Representative engagements include product miners and manufacturers, suppliers, component part integrators, retailers and property owners against nearly every form of malignant, non-malignant and wrongful death claim in every major venue in Florida. Engagements have included the defense of industrial plant operators, mine operators, heavy equipment manufacturers, energy suppliers, wire and cable suppliers, industrial brake and clutch manufacturers, floor tile and adhesive suppliers, joint compound suppliers, and entities involved in the sale or supply of various body powder products. Though we pride ourselves in achieving favorable settlements for our clients, over the years we have also obtained countless no-cost dismissals and summary judgments in toxic tort cases, as well. If you are looking for direct representation, or a firm to handle local-counsel responsibilities, we are your Firm.
Professional liability claims are inherently difficult both to prosecute and defend because they are generally disputes over judgment. Judgment is not science, judgment is human, so a comprehensive understanding of the discipline, of applicable codes and standards, and of every fact and issue of a dispute are just the start of our representation in these cases. Getting the right documents, hiring the right experts, and developing ways to effectively communicate our client’s position to an arbitrator, judge or jury is where the Weinstein Trial Firm delivers. Over the years we have represented architects, structural engineers, electrical engineers and other licensed professionals, both directly and through insurers, in a variety of different claims and projects.
As a large and growing area of our practice, the Weinstein Trial Firm is actively engaged in numerous construction defect claims throughout the State of Florida. Our engagements range from simple subpoena assistance and Chapter 558 investigations to defending our clients in multi-party litigated claims all the way through trial. Our engagements involve every form of construction including single family homes, townhomes, mid and high-rise condominiums, airports, hospitals and libraries, and everything between. We have represented clients in ground-up construction, renovation and modernization projects, and we have experience defending and prosecuting claims based in contract, codes, statutes or common-law. Litigating disputes over insured or additional insured status, as well as contractual and common-law indemnification are key components of our typical representation, and we have a deep understanding of the nuances of these claims which we leverage to our clients’ advantage. We also assist our clients enforcing or seeking the discharge of mechanics’ liens, enforcing or defending payment or performance bond claims, and pursuing liens or claims transferred to bonds.
Although the Weinstein Trial Firm primarily represents self-insureds and those with large self-insured retentions, the Weinstein Trial Firm also represents the interests of several major insurers, both directly and on behalf of their insureds, in a wide variety of claims including personal injury, product liability, property damage, professional liability and commercial disputes. The Firm understands the need for budgets, periodic reporting and guideline billing, and works with both the insurers and insureds to provide an effective but efficient defense that best protects the interests of the both.
Although we are proud of our courtroom successes, first-chairing trials and arbitrations is not all we do. Our Firm is often asked to join and support existing trial lawyers, especially in complex or high exposure matters, to add depth of experienced and capable trial counsel where and when it is needed. Upon engagement we are quick studies of entire case files no matter how large or complicated they may be, and we offer prompt evaluation and analysis of key areas we think we can be most effective and know we can offer the most value. It is always best to get us involved early, but no matter how close to trial your matter may be and no matter what venue the matter is located, if you are in need of second chair or trial counsel assistance, ask us to parachute in. We got you covered.
I spent twenty-five years growing the complex commercial litigation, products liability defense and construction defect litigation groups at regional and national firms, which includes first chairing numerous jury trials on behalf of some of the largest companies in the world. These experiences have taught me many important lessons, but none so compelling as this one: sophisticated clients need better representation. Universally, better representation.
I have worked hard to be an innovative and effective advocate for so many organizations and individuals, and I am proud to have mentored many others to be the same. Those who work with me know what success in a courtroom looks like and know how to leverage a deeper understanding of the law, technology, rules of evidence and civil procedure in order to achieve cost-effective, expedient and, frankly, better results. And how do we know they are better? Because our results are meaningful, memorable and routinely exceed our client’s expectations.
I formed Weinstein Trial Firm with a mission to offer skilled trial counsel to individuals and companies in nearly every industry; to give reasoned advice, up-to-the-minute guidance on changing risks, and demonstrably high-quality lawyering to those who trust in us; and to passionately defend and prosecute our client’s interests in courtrooms across Florida and beyond. For our clients, the courtroom is no longer considered a dangerous place to be. With our focus on results, we will always deliver the highest caliber of legal advocacy for those we are proud to call clients of the Firm.
